Court orders shifting of detainee to Srinagar

Srinagar: After hearing case of Tariq Ahmad Shah, son of Gh. Nabi Shah, resident of Babmohalla Bijbehara who has been jailed under Public Safety Act, District and Session Judge Anantnag: passed an order Saturday, directing the administration to transfer him from Kotbilwal Jail to Central Jail Srinager.

Counsel of  Shah pleaded in the Court that police has not only harassed Shah, but tortured him on 31, October, while he was being shifted from Kot Bilwal Jail to district court Anantnag, where his trial hearing was fixed on Saturday.

Shucking his shirt off, in the Court, the accused showed the torture marks to the Judge, who took a serious view of it with the direction that the detainee be shifted from the Kot Bilwal without any delay.

Tariq Ahmad Shah was one among the 12 persons, who were arrested from Former Chief Minister, Mufti Mohd. Syeed’s home town Bijbehara in 2005 under the Public Safety Act. Since 2005, the draconian act has been slapped on him time and again to impede the chances of his release.

” My son was arrested in 2005 against an FIR, 54-2005, sec. 307-7/27 under Public Safety Act and detained for 18 months. On 21-06-07, he was released after the detention order was quashed by the court but with the elapse of only two months my son was arrested again”, Gh. Nabi Shah, the deatinees father told Press Bureau of India.

“He was rearrested on 29-11-07 under the same act and an FIR 254-07-7/25 was registered agains him. He was then shifted to Kot Bilwal Jail”, Shah added.

Expressing his shock over the alleged inhumane treatment to his son by the police, Shah told PBI, ” on 11 August this year, during the barrack change at Kot Bilwal, my son was thrashed an humiliated by the police after a pocket copy of the holy Quran dropped from his pocket.
